Issuance of the Amended Implementing Regulations of the “GCC” Patent Law

In the implementation of the decision of the Supreme Council of the Cooperation Council for the Arab States of the Gulf (GCC) issued in the 41st session of the Supreme Council of the Gulf Cooperation Council (GCC) ) approving the amended GCC Patent Law, the Trade Cooperation Committee of the Gulf Cooperation Council (GCC) in its (60th) meeting held on June 27, 2021, rendered its decision approving the Amended Implementing Regulations of the “GCC” Patent Law System

The new implementing regulations have been published the official Gazette of the General Secretariat of the Cooperation Council for the Arab States of the Gulf No. 25th on 01 November 2021 and shall come into force on 01 February 2022.

By the issuance of the new implementing regulations, it will be moved from the Unitary GCC system to a Country-designated system.

To Recall, the provisions of Articles (1, 4, 9, 17- 20, 21, 25, 28- 30, 32, and 33) of the GCC patent law have been amended.

The most important amendments are summarized in that the GCC patent office shall receive the new patent applications including the examination and granting process only subject to the request of any one of the GCC countries with the application of the national legislations of the requesting member state.

No patent will be granted by the GCC patent office unless subject to the approval of the national office at the requesting member state. All patents previously issued by the GCC patent office shall remain valid for the legally prescribed period of protection in all states of the Gulf Cooperation Council.
